Ownership and Operation
The website www.jakpa.io (herein referred to as JAKPA) and all its resources are owned, operated and maintained solely by ACAID LLC, a limited liability company legally registered in the State of Delaware. The website, all associated services and related content/materials are provided exclusively by ACAID LLC and its owners, EB2-NIW consultants, employees and associates (herein after referred to as “We”, “Us” and “Our”).
Website Purpose
The goal of JAKPA is to enable rapid, effortless and convenient creation of EB2-NIW petitions for eligible clients (herein after referred to as “the petitioner” or “petitioners”) without direct legal representation. Interested visitors that wish to use our services are required to upload their up-to-date resumés to our servers. We then review uploaded resumés to identify personalized strategies for creating and compiling very compelling EB2-NIW petitions and implement these strategies after payment has been made. The scope of our services includes preparing cover letters, compiling relevant forms (e.g., I-140) and supportive evidence, and submitting finalized petitions to US Customs and Immigration Service (USCIS).
Guarantees and refunds
Total costs of our services cover USCIS filing fees, certified evaluation of non-US graduate certificates and transcripts (if applicable), certified translation of non-english graduate certificates and transcripts (if applicable), administrative costs (for printing, packaging and shipping petitions to USCIS), and our consultancy fee. As USCIS determines the outcome of each petition, we do not guarantee approval of any EB2-NIW petition that we prepare. Petitioners that receive requests for evidence, notices on intent to deny, denial notices, open investigations for fraud or misrepresentation and notices of intent to revoke (for petitions approved in error) from USCIS are strongly encouraged to seek and retain qualified legal counsel from an immigration attorney fully licensed to practice law within the United States or their state. Payments for our services are nonrefundable with two exceptions: if a petitioner receives a request for evidence from USCIS (50% of our consultancy fee shall be refunded); or if petitioners do not authorize submission of their finalized petitions (administrative costs and USCIS filing fees shall be refunded).
Not Legal Advice or Services
Use of JAKPA and its resources do not constitute, create, imply or serve as a substitute for formal immigration legal advice or direct services from an experienced attorney. Although we assist with EB2-NIW self-petitioning, under no circumstance shall any of our services or products be considered individualized legal counsel or representation. Laws and governmental processes can frequently change. Thus, for any and all legal questions related to unique immigration situations, eligibility factors or filing concerns that demand up-to-date definitive answers or direction, petitioners must independently seek and retain qualified legal counsel from an immigration attorney fully licensed to practice law within the United States or their state.
Disclaimers
While we may use credible supportive evidence from both public and private domains to make petitions more compelling, their authors and publishers are wholly responsible for the accuracy, authenticity and currency of indicated documents. Additionally, petitioners are wholly responsible for a) the accuracy and authenticity of personal documents used to create EB2-NIW petitions (including resumes, certificates, transcripts, letters of support, biographic pages of passports and I-90 [if applicable]), and b) accuracy and completeness of all relevant forms that are submitted with the EB2-NIW petition. Specifically, we neither serve nor identify as preparers or interpreters of indicated forms, and petitioners are strongly encouraged to independently seek out these services if required.
Lastly, while we may use third party agents to provide certified evaluation and translation services, these agents guarantee the accuracy of their evaluations and translations.
Fraud and misrepresentations
We strongly discourage fraud or misrepresentations in EB2-NIW petitions. By law, noncitizens who fraudulently or willfully misrepresent material facts (e.g., through falsification or concealment) in immigration proceedings render themselves inadmissible to the United States. Such individuals will have their petitions denied, face severe penalties (including deportation), and may be subject to criminal prosecution. Hence, petitioners are strongly encouraged to carefully review all finalized petitions before approving it for submission under penalty of perjury.
